Possession Order for District Council home secured following serious anti-social behaviour

On 11 September at Nottingham Magistrates’ Court, the Judge granted the District Council an immediate possession order so they could take back the property the very same day, after hearing how the tenant had been in breach of their tenancy conditions.

The offender had previously been offered numerous levels of support, all of which had been rejected, and their behaviour continued to escalate.

Councillor Lee Brazier, Portfolio Holder for Housing at Newark and Sherwood District Council, said: “Firstly I would like to reassure everyone of our strong stance on dealing with anyone who breaches their tenancy agreement with us. It will not be tolerated and our staff work tirelessly to ensure justice is served and that communities can live in peace and without fear.

“I would also like to remind residents that our staff are here to help and are available to speak to you in confidence should you be facing any issues yourself. If you live in a Council property or would like to report the behaviour or actions of someone who does, you should ask to speak to your local Tenancy Officer.

“For wider issues, you can ask to speak to the anti-social behaviour team or you can use the online anti-social behaviour reporting form. If you live in a privately rented property, please make your landlord aware of any problem you’re experiencing.”

Newark and Sherwood District Council and Nottinghamshire Police worked in partnership throughout the tenancy enforcement process.

Inspector Charlotte Ellam, District Commander for Newark and Sherwood, said: “Tackling anti-social behaviour remains a key priority for our neighbourhood policing team because we know how much of an impact this type of offending can have on people’s lives.

“Our officers do so much work each day to crackdown on this type of offending, with much of this seeing us work in collaboration with our partners, including Newark and Sherwood District Council, to help make our communities better places to live.

“With this in mind, we were pleased to be able to support the council in carrying out this immediate possession order to remove a tenant from a property following a series of reports of anti-social behaviour that breached the conditions of their tenancy agreement.”
