Leasehold services are based within the Customer Services Directorate of Newark and Sherwood Homes, within the Tenancy and Estates Team.
This service area covers a wide range of services, some of which are provided by other directorates. Our aim is to ensure that all the Council's leaseholders have access to all these services and have a direct link to our leasehold service should they wish to discuss the terms and conditions of their lease or if they require any advice or information.
WHAT IS LEASEHOLD?
Leasehold ownership is basically a long tenancy, that is, the right to occupy your flat for a set period of time (known as the 'term' of the lease). This period is usually for 99 or 125 years.
Ownership usually consists of everything within the property including the floorboards, plastering to the walls and ceilings and all items that serve the property alone. Your landlord has responsibility for the maintenance and repair of the building and owns the structure and communal areas including the land it stands on.
WHAT IS A LEASE?
A Lease is the legally binding document that sets out the responsibilities of both the landlord and the leaseholder. This may include certain conditions on the use and occupation of the property.
When a lease is sold, the seller assigns all the rights and responsibilities of the lease to the purchaser together with any future service charges that have not been identified and may also include charges due that have not yet been paid.
THINKING OF BUYING A LEASEHOLD FLAT?
If you are considering buying a Council-owned leasehold flat please ensure that your solicitor explains the details of the lease clearly. Although we will be pleased to answer any queries we would always advise you to ensure that you seek professional, independent advice before you go ahead with the purchase either on the open market or through the 'Right to Buy'.
WHAT ARE SERVICE CHARGES?
Service charges are the variable costs that require a contribution from a leaseholder for the day-to-day repair, maintenance and management of the building of which their leasehold property forms part. The lease will detail the relevant proportion of these costs and what items or services are applicable.
This service area is responsible for the annual billing of these charges. An information leaflet is sent out with each account that answers some of the most frequently asked questions.
WHAT ABOUT GROUND RENT AND BUILDINGS INSURANCE?
Please note that ground rent (the rental payment for the ground your property stands on) and buildings insurance premiums are invoiced separately by Newark and Sherwood District Council's Finance Department. DO YOU HAVE A LEASEHOLDERS GROUP?
Newark and Sherwood Homes are committed to assisting leaseholders support themselves and exchange information, concerns and ideas collectively. Although many of our services are provided to both leaseholders and tenants, the Leaseholders Monitoring Group has been established to address the concerns specific to leaseholders.
Public meetings are held two-three times a year and are open for all leaseholders to attend. Details of the meetings will be sent out to current leaseholders shortly before the meetings are due to take place. Details of this years' meetings are listed below:
We are currently in the process of undertaking a review of our resident involvement and, taking into account your views from the recent Group Survey, we are expecting to improve our communications and encourage more direct involvement with residents, leaseholders and tenants in the development of our services.
